Welcome to SASH (Smart Assisted Housing). These Terms of Service ("Terms") govern your access to and use of our website, services, and SASH housing with integrated Remote Patient Monitoring (RPM) technology. By accessing our website or applying for SASH housing, you agree to be bound by these Terms.
If you do not agree to these Terms, you may not access or use our services. We reserve the right to modify these Terms at any time, and your continued use of our services constitutes acceptance of any changes.
- "SASH," "we," "us," or "our" refers to Smart Assisted Housing and its affiliates
- "Services" includes our website, housing application platform, SASH homes, and RPM technology
- "Resident" or "you" refers to individuals who apply for, lease, or reside in SASH homes
- "RPM" refers to Remote Patient Monitoring services and medical devices integrated into SASH homes
- "Healthcare Provider" refers to physicians, nurses, and medical professionals authorized to access your health data
Age Requirement
You must be at least 18 years old to apply for SASH housing or create an account on our website. By using our services, you represent and warrant that you meet this age requirement.
Account Accuracy
You agree to provide accurate, current, and complete information during the housing application process and to update this information as necessary. Providing false or misleading information may result in termination of your application or lease agreement.
Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access or security breach.
Application Process
Submitting a housing application does not guarantee approval or availability of a SASH home. Applications are subject to:
- Credit and background checks
- Income verification and affordability assessment
- Eligibility for government housing assistance programs (if applicable)
- Availability of homes in your desired location
- Compliance with local housing regulations
Lease Agreement
Upon approval, you will enter into a separate Residential Lease Agreement that governs your tenancy. The lease agreement includes terms regarding rent, security deposits, maintenance responsibilities, lease duration, and termination conditions. These Terms of Service do not replace or supersede the lease agreement.
Rent-to-Own Options
Where available, rent-to-own programs allow residents to apply a portion of rent payments toward eventual home ownership. Specific terms, eligibility requirements, and conditions are outlined in separate Rent-to-Own Agreements.
Voluntary Participation
Participation in RPM services is voluntary. However, SASH homes are designed with integrated RPM technology, and declining RPM services may affect your eligibility for certain housing units or healthcare reimbursement programs.
Not a Substitute for Medical Care
RPM services are intended to supplement, not replace, professional medical care. You must continue to see your healthcare providers for regular checkups, diagnoses, and treatment. RPM devices monitor vital signs but do not diagnose medical conditions or provide medical advice.
Device Usage and Maintenance
As a resident using RPM services, you agree to:
- Use RPM devices as instructed by healthcare providers and SASH staff
- Report device malfunctions or technical issues promptly
- Allow SASH technicians to access your home for device installation, maintenance, and repairs
- Return all RPM devices upon lease termination or discontinuation of RPM services
- Not tamper with, modify, or attempt to repair devices yourself
Emergency Response
While RPM devices can detect certain health emergencies and send alerts, you must call emergency services (911 or local equivalent) immediately in life-threatening situations. Do not rely solely on RPM alerts for emergency response.
Your privacy is important to us. Our collection, use, and disclosure of your personal information and Protected Health Information (PHI) are governed by:

By using our services, you consent to the collection and use of your information as described in these policies.
SASH Ownership
All content on our website, including text, graphics, logos, images, software, and RPM technology, is the property of SASH or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.
Limited License
We grant you a limited, non-exclusive, non-transferable license to access and use our website for personal, non-commercial purposes. This license does not include the right to download (except for page caching), modify, or reverse-engineer any portion of our services.
Trademarks
"SASH," "Smart Assisted Housing," and related logos are trademarks of SASH. You may not use these trademarks without our prior written consent.
You agree not to:
- Violate any applicable laws, regulations, or third-party rights
- Provide false or misleading information in housing applications or account registration
- Use our services for any fraudulent, illegal, or unauthorized purpose
- Interfere with or disrupt the operation of our website or RPM technology
- Attempt to gain unauthorized access to our systems, networks, or user accounts
- Upload or transmit viruses, malware, or other malicious code
- Harass, threaten, or harm other users, residents, or SASH staff
- Scrape, data mine, or use automated tools to collect information from our website
- Sublease or transfer your SASH home without written permission
- Damage, modify, or tamper with SASH property or RPM devices
No Warranties
Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our services will be uninterrupted, error-free, or secure.
Medical Disclaimer
RPM services and health information provided through our platform are for informational purposes only and do not constitute medical advice, diagnosis, or treatment. Always seek the advice of your physician or qualified healthcare provider with any questions regarding a medical condition.
Limitation of Liability
To the fullest extent permitted by law, SASH and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of our services, even if we have been advised of the possibility of such damages.
In no event shall our total liability to you for all claims exceed the amount you paid to SASH in the twelve (12) months preceding the claim (or $100 if no payments were made).
You agree to indemnify, defend, and hold harmless SASH and its affiliates, officers, directors, employees, agents, and partners from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of our services or SASH housing
- Your violation of these Terms or applicable laws
- Your violation of any third-party rights, including intellectual property or privacy rights
- Any damage to SASH property or RPM devices caused by your negligence or intentional misconduct
Informal Resolution
Before filing a formal claim, you agree to contact us at [email protected]to attempt to resolve the dispute informally. We will work in good faith to resolve disputes within 30 days.
Binding Arbitration
If informal resolution fails, any dispute arising out of or relating to these Terms or our services shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted in Champaign, Illinois, USA, or another mutually agreed location.
Exception: Either party may seek injunctive or equitable relief in court to prevent infringement of intellectual property rights or unauthorized access to systems.
Class Action Waiver
You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as a class action, consolidated action, or representative action. You waive your right to participate in a class action lawsuit or class-wide arbitration.
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to its conflict of law principles. For residents in Ghana or Botswana, local housing and consumer protection laws shall also apply to the extent they provide greater protections than these Terms.
Any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in Champaign County, Illinois, and you consent to the personal jurisdiction of such courts.
We reserve the right to suspend or terminate your access to our services at any time, with or without cause, and with or without notice, for conduct that we believe:
- Violates these Terms or applicable laws
- Harms or poses a risk to other users, residents, or SASH
- Exposes SASH to legal liability
- Is fraudulent, abusive, or otherwise objectionable
Termination of your account does not affect your obligations under an existing lease agreement, which remains in full force and effect until terminated in accordance with its terms.
We may modify these Terms at any time by posting the updated Terms on our website with a new "Last Updated" date. Material changes will be communicated via email to registered users and written notice to current residents. Your continued use of our services after the effective date of the updated Terms constitutes acceptance of the changes.
If you do not agree to the updated Terms, you must discontinue use of our services. For current residents, lease agreements remain in effect under the terms agreed upon at the time of signing, unless both parties agree to amendments.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.
These Terms, together with our Privacy Policy, HIPAA Compliance Statement, and any applicable lease agreements, constitute the entire agreement between you and SASH regarding your use of our services and supersede all prior agreements, understandings, and communications, whether written or oral.
